Pool Planner AI offers Pool Planner AI and related services to you, a user, under the condition that you accept all of our set terms, including these Terms of Service and all related policies.

By accessing and using the Pool Planner AI product, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please refrain from using our product.

2. Product Description

Pool Planner AI allows users to upload a photo of their backyard. In response, users will receive pictures of their backyard, each depicting different pool styles and shapes.

3. Use of the Product

Upon successful payment, users will receive their set of images.

4. Ownership & Usage Rights

a) User Ownership: Upon receipt of the generated images, the user retains full ownership rights over the images produced by Pool Planner AI. Users have the unrestricted right to use, modify, distribute, and reproduce the images in any manner and for any purpose they see fit.

b) License Grant to Pool Planner AI: By uploading photos ("User Content") and generating images ("Generated Content") through our service, you grant Pool Planner AI a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, publish, distribute, and display the User Content and Generated Content for the purposes of operating, improving, and promoting our services.

c) Marketing Use: Specifically, you agree that Pool Planner AI may use your uploaded backyard photos and the resulting AI-generated pool designs in our marketing materials, including but not limited to social media posts, website galleries, advertisements, and case studies, without further compensation or notification to you.

5. User Responsibilities

Users must:

Ensure they have the rights to the photos they upload.

Not upload content that is illegal, defamatory, or offensive.

Comply with all applicable laws while using the product.

6. Intellectual Property

While users own the images produced by Pool Planner AI, all underlying software, algorithms, designs, and intellectual property related to Pool Planner AI remain the exclusive property of Pool Planner AI. Unauthorized use or duplication of our software or methodologies without express written permission is prohibited.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Pool Planner AI and it's owners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Pool Planner AI.

8. Refund Policy

All sales are final. Due to the digital nature of our product, refunds are not provided once the images have been generated and delivered.

9. Termination

We reserve the right to suspend or terminate your access to our product at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, third parties, or for any other reason.

10. Changes to Terms of Use

11. Governing Law
